THE VINEET GUPTA CASE

In Vineet Gupta v. Union of India, decided on 10 February 2026, the Delhi High Court considered LOCs issued against two individuals who were associated with Parabolic Drugs Ltd.

The company had obtained credit facilities from banks. The accounts were subsequently declared fraudulent, followed by CBI proceedings and an ED prosecution complaint. The petitioners challenged the LOCs and also sought permission to travel abroad.

THE POINT OF THE JUDGMENT

The Court emphasised that the right to travel abroad is part of personal liberty protected under Article 21 of the Constitution.

It also examined the established LOC framework and earlier Delhi High Court decisions.

The important distinction was this:

A Look-Out Circular is not supposed to become an automatic tool for every loan default or commercial dispute.

The Court referred to decisions holding that LOCs are exceptional and coercive measures and that the authorities must apply the applicable legal parameters rather than mechanically restricting someone's international travel.

In the case before it, the Court ultimately quashed the LOCs against the petitioners.
